PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR WEBSITE OR PLACING AN ORDER. BY ACCESSING OUR WEBSITE AND/OR MAKING A PURCHASE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS.

These Terms and Conditions ("Terms") govern your use of our website www.latinaformalwear.com (hereinafter, the "Site") and the purchase of products offered by LATINA FORMAL WEAR (hereinafter, "we", "us", "our", or "the Store"). By using our Site and/or placing an order, you (hereinafter, "User" or "Customer") confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree with these Terms, please do not use our Site or make purchases.

3. Products and Services

LATINA FORMAL WEAR offers new women's clothing, specializing in garments for Quinceañeras, Cocktail events, Baptisms, and First Communions.

We strive to describe and display our products as accurately as possible. However, colors and details may vary slightly due to the User's device screen settings and photographic limitations.

Sizing Guides: We provide sizing guides to help Customers select the appropriate size. It is the Customer's responsibility to consult these guides before placing an order. LATINA FORMAL WEAR is not responsible for incorrect size selection by the Customer.

4. User Accounts

Customers may choose to create a user account or make purchases as guests.

If you create an account, the Customer agrees to:

  • Provide true, current, and complete information, including name, address, and phone number.
  • Maintain the confidentiality of their password and account.
  • Notify us immediately of any unauthorized use of their account. The Customer is responsible for all activities that occur under their account.

5. Prices and Payments

  • Prices: All prices are displayed in US Dollars (USD) and include applicable taxes. LATINA FORMAL WEAR reserves the right to modify prices at any time without prior notice. Such changes will not affect orders already confirmed.
  • Pricing Errors: We strive to display accurate prices. However, errors may occur. If we detect a manifest error in the price of a product you have ordered, we will inform you as soon as possible, giving you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you using the details provided, the order will be treated as canceled, and any amount paid will be refunded.
  • Payment Methods: We accept credit/debit cards and PayPal. Payment must be completed in full before the order is shipped.
  • Security: We use secure payment platforms. However, LATINA FORMAL WEAR will not be liable for security breaches of third-party payment processors.

6. Order Process and Confirmation

  • Placing an Order: The Customer selects the products and proceeds to payment through the Site.
  • Order Confirmation: Once the order has been processed and payment verified, the Customer will receive a confirmation email with the details of their purchase. This email constitutes our acceptance of the order.
  • Stock Availability:
    • If a product is in stock, the estimated delivery time is 3 to 7 business days within the United States.
    • In the event that an ordered item is not in stock for immediate shipment, LATINA FORMAL WEAR will contact the Customer directly to coordinate an approximate delivery date. The "No Returns, No Exchanges" policy still applies to these orders once the new delivery date is confirmed by the Customer and the order is processed.
  • We reserve the right to refuse or cancel any order at our discretion, including, but not limited to, orders that appear fraudulent or violate these Terms.

7. Shipping and Delivery

  • Shipping Area: We only ship within the United States (USA).
  • Shipping Costs: Shipping costs are calculated based on the order amount and package weight. They will be communicated to the Customer during the checkout process, before final order confirmation. Occasionally, we may offer free shipping under conditions that will be duly communicated through our Site.
  • Delivery Times: Delivery times are estimates and may vary due to factors beyond our control (carrier delays, weather conditions, etc.). LATINA FORMAL WEAR is not responsible for delivery delays once the package has been dispatched with the courier service (USPS, UPS, DHL, FedEx, or other selected).
  • Shipping Address: The Customer is responsible for providing a complete, accurate, and up-to-date shipping address. If an order is returned to LATINA FORMAL WEAR due to an incorrect, incomplete address, or because the recipient was not available, the Customer will be responsible for reshipment costs.
  • Product Responsibility: Responsibility for the products transfers to the Customer once the order has been handed over to the carrier.

8. NO RETURNS, NO EXCHANGES, AND NO REFUNDS POLICY

ALL SALES ARE FINAL. LATINA FORMAL WEAR DOES NOT OFFER RETURNS, EXCHANGES, OR REFUNDS ON ANY PRODUCTS PURCHASED THROUGH OUR WEBSITE.

  • No Exceptions: This policy applies to all items, regardless of the reason, including, but not limited to: incorrect size selection, change of mind, the product not meeting customer expectations upon receipt, or manufacturing defects not apparent to us prior to shipment (we perform quality control, but this is a precaution).
  • Recommendation: We urge you to carefully review the product description, images, and sizing guides before making your purchase. If you have any questions about a product, please contact us at contact@latinaformalwear.com BEFORE placing your order.
  • Defective Products or Incorrect Order Due to Our Error: In the unlikely event that you receive a significantly factory-defective product (not related to shipping) or an incorrect item that does not match your confirmed order, you must contact us at contact@latinaformalwear.com within 48 hours of receiving the package, providing clear photographic evidence of the defect or error. We will evaluate the case and, at our sole discretion, may offer a solution that WILL NOT involve a monetary refund, but possibly a store credit or similar alternative if we so determine. Shipping costs for any return exceptionally approved under this clause will be covered by the customer, unless LATINA FORMAL WEAR explicitly states otherwise in writing. The final decision on how to proceed in these exceptional cases rests solely with LATINA FORMAL WEAR.

9. Intellectual Property

All content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, as well as product designs, are the property of LATINA FORMAL WEAR or its content suppliers and are protected by United States and international intellectual property laws. The reproduction, modification, distribution, transmission, republication, display, or performance of such content without our express written consent is strictly prohibited.

10. User-Generated Content (Reviews)

LATINA FORMAL WEAR may allow registered Customers who have made a verifiable purchase to submit product reviews. By submitting a review, you:

  • Grant LATINA FORMAL WEAR a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
  • Warrant that the content is accurate, that you are the author, and that use of the content you supply does not violate these Terms and will not cause injury to any person or entity. We reserve the right (but not the obligation) to monitor, edit, or remove any user-generated content at our sole discretion.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT(S) IN QUESTION.

14. Indemnification

You agree to indemnify, defend, and hold harmless LATINA FORMAL WEAR and our directors, officers, employees, contractors, agents, suppliers, and licensors, from and against any and all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising from or relating to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

LATINA FORMAL WEAR reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. You agree that any legal action or proceeding between LATINA FORMAL WEAR and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Austin, Travis County, Texas, United States.

17. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
